Article 1 (Purpose and Scope) These Terms set out the conditions for using the information service and enquiry intake (the "Service") provided by Homes Company Japan Co., Ltd. (the "Company") at japan.homes.global (the "Site"). Membership registration and accounts are governed separately by the Membership Terms.
Article 2 (Definitions) (1) "User" means any person browsing or using the Site. (2) "Member" means a User who has agreed to the Membership Terms and registered an account. (3) "Property Information" means information on buildings, room types, rates and move-in availability operated by the Company.
Article 3 (Membership Registration) (1) Registration is completed by signing in with a Google account (SSO). (2) Registration is free of charge. (3) Account conditions are governed by the Membership Terms and the Consent to Collection and Use of Personal Information. (4) Browsing the Site and sending an enquiry do not require registration.
Article 4 (Contents of the Service) The Service comprises (1) browsing and searching Property Information, (2) receiving enquiries, and (3) membership registration. No lease agreement is concluded and no payment is processed on this Site.
Article 5 (Lease Agreement) A lease agreement is formed only under a separate written contract, after the process guided by our staff following your enquiry (viewing, screening, execution of the contract). Information displayed on the Site constitutes neither an offer nor an acceptance.
Article 6 (Conditions Applicable to Displayed Rates)
Article 7 (User Obligations and Prohibited Acts) Users shall not (1) submit false information, (2) reproduce, republish or commercially exploit Site content without the Company's permission, (3) conduct bulk access or data collection by automated means, or (4) act in violation of law, these Terms or public order and morals.
Article 8 (Personal Information) Personal information is handled in accordance with the Privacy Policy. For cookies and external transmission, see "Disclosure on External Transmission".
Article 9 (Intellectual Property) Rights in the text, images, floor plans, logos and other works on the Site belong to the Company or the rightful owners.
Article 10 (Disclaimer) (1) While the Company endeavours to keep Property Information accurate, rates and availability change and the completeness of the information at any given time is not guaranteed. (2) The Company is not liable, to the extent permitted by law, for failures caused by force majeure or by third-party services such as Google.
Article 11 (Changes and Suspension) The Company may change or suspend the Service for operational or technical reasons. Material changes will be announced on the Site in advance.
Article 12 (Exclusion of Organised Crime Groups) Users represent and warrant that they are not members of any organised crime group or similar organisation.
Article 13 (Governing Law and Jurisdiction) These Terms are governed by Japanese law, and the court having jurisdiction over the Company's head office shall be the court of first instance.
Article 14 (Amendment) Amended Terms take effect when posted on the Site.
